What is an accessibility statement?
The accessibility statement is a legally required document that public bodies must publish on their websites. It describes the current state of conformance with WCAG 2.1 / BITV 2.0, known exceptions and non-conformant content with justification, a feedback mechanism, and the enforcement procedure for unsatisfactory responses.
The legal basis is EU Directive 2016/2102, implemented in Germany by BITV 2.0 and the Disability Equality Act (BGG).
Who is affected?
The obligation applies to municipalities, cities, districts and their enterprises, federal and state authorities, subordinate authorities, public broadcasters, universities, schools, and companies with a public mandate (e.g. utilities, public transport operators).
Purely private companies are not directly required to publish a statement — but the BFSG imposes similar information and feedback obligations.
The problem with boilerplate statements
Many public bodies publish accessibility statements generated from templates — without an underlying audit. The problem: A statement claiming conformance without verification is a false declaration. Authorities increasingly check whether statements reflect the actual conformance status. Users can file complaints — with legal consequences for the organization.
A statement is only as good as the audit it is based on.
